Trader’s Obligations
• The trader is obliged to deliver to the consumer goods that comply with the conditions stipulated in the contract.
• Goods are considered compliant with the contract if they correspond to the description provided by the trader to the consumer and have the same characteristics as the sample presented by the trader to the consumer.
• In the absence of a description provided by the trader, goods are considered compliant with the contract if they are suitable for the purpose about which the consumer informed the trader at the time of concluding the contract and which the trader agreed to.
Legal Warranty
• If the goods are found to be defective, the consumer has the right to request that the trader eliminate the defect (free repair or replacement of the goods, price reduction) or withdraw from the contract.
• Repair and replacement of goods are the consumer’s primary rights. The consumer has the right to request free repair or replacement, except when this is impossible due to the nature of the goods or would require disproportionate or unreasonable costs.
• Goods must be repaired or replaced within a reasonable time (replacement – no later than 10 calendar days from detection of the defect, and standard repair – no later than 30 calendar days from detection of the defect), without causing significant inconvenience to the consumer, considering the nature and purpose of the goods.
• Free repair or replacement means that the trader bears all costs (including postage, labor, and material costs) necessary to ensure the conformity of the goods with the contract.
• The consumer has the right to request a price reduction or terminate the contract if one of the following conditions exists:
• Repair or replacement is impossible
• The trader has not repaired or replaced the goods within a reasonable time and the consumer has lost interest in contract performance
• Repair or replacement would cause significant inconvenience to the consumer
• In case of contract termination, the consumer has the right to claim compensation for damages caused by non-performance in accordance with Georgian law.
• The consumer does not have the right to terminate the contract if the defect is minor.
• The consumer may exercise the above rights if the defect is discovered within 2 years of receiving the goods.
• If the defect is discovered within 6 months of receiving the goods, it is presumed (unless proven otherwise) that the defect existed at the time of delivery, if this is possible considering the nature or type of defect. In this case, the burden of proof lies with the trader. If the defect is discovered after 6 months, the burden of proof that the defect existed at the time of delivery lies with the consumer.
Order Acceptance
• The consumer may purchase goods by bank transfer. It is also possible to pay in cash to the courier upon delivery.
• From the moment the payment is credited to the bank account, the trader is obliged to process the order within no more than two days. Delivery time to the consumer must not exceed 30 days from order processing.
• The order is considered completed once the goods are delivered to the consumer.
• If delivery is not possible, the order is canceled and the customer is refunded.
• The consumer is obliged to inspect the goods upon receipt and confirm with a signature that the item has no visible defects.
• The trader is obliged to provide all documents related to the order upon request.
Unconditional Return Policy
• The consumer has the right to withdraw from a distance or off-premises contract within 14 calendar days without giving any reason.
• This period is calculated:
• For service contracts – from the date of conclusion of the contract
• For goods contracts – from the moment the consumer or a third party (other than the carrier) receives the goods
• For partial deliveries – from the receipt of the last item
• For regular deliveries – from the first receipt of goods
Return Conditions
• To use the unconditional return right, the consumer must contact the call center: 032 2 400 001.
• In case of withdrawal, the consumer must:
• Return the goods immediately after notifying withdrawal, but no later than 7 calendar days
• Bear the direct costs of returning the goods
• If the product does not match website specifications, has an initial defect, or is damaged during transport, return costs are covered by the trader.
• The consumer must return the item fully, together with all accompanying documents.
• The trader must refund the payment within 14 calendar days after receiving the return notice. The trader may withhold the refund until goods are received or proof of shipment is provided.
• Refunds are made using the same payment method unless the consumer agrees otherwise.
• Withdrawal from the contract automatically cancels related contracts and restores the original state.
Exceptions to Withdrawal from Contract Without Providing Any Reason
• Goods or services supplied that are made according to the consumer’s individual order
• Sealed goods where the seal was broken after delivery and return is not possible due to health or hygiene reasons
• Goods that, due to their nature, become inseparably mixed with other goods after delivery
• The consumer does not have the right to withdraw from goods or services priced at 30 GEL or less
Force Majeure
• Neither party shall be held responsible for partial or complete failure to fulfill obligations if such failure is caused by natural disasters, technological catastrophes, fire, war actions, or government decisions, provided that these events began or developed after the purchase of the order.
• If any of the above circumstances directly affect the deadline for fulfilling obligations under these consumer terms and conditions, the deadline shall be extended for the duration of the force majeure event.
• The party affected by force majeure is obliged to inform the other party about the occurrence, expected duration, and termination of such circumstances.
• The facts stated in the notification must be confirmed by the relevant regional authority: trade, industrial, or other competent body.
• Failure to notify or delayed notification deprives the party of the right to invoke force majeure as a basis for exemption from liability.
